Introduction
Presago S.r.l. (“Presago”, “We”, “Us” or “Our”) is committed to protecting your privacy. This Privacy Policy (“Policy”) explains how we collect, use, share and protect Personal Data when you visit our websites, use our software applications and cloud-based products (“Products”), contact us, request support or otherwise interact with us (collectively, the “Services”).
“Personal Data” means information relating to an identified or identifiable individual. “You” means an individual who uses or interacts with the Services, including an authorized user, website visitor, customer representative or business contact.
Depending on the context, Presago may act as a controller of Personal Data, including in connection with our websites, business relationships, accounts, subscriptions, support, security and communications, or as a processor or service provider when processing Personal Data through our Products on behalf of a customer. Where Presago acts as a processor, such processing is governed by the applicable Data Processing Agreement (“DPA”) and the customer’s instructions.
The data processed and the way it is handled may vary depending on the Product. Depending on the applicable functionality, data may be transmitted, processed temporarily or stored by Presago. Further details may be provided in the applicable Product documentation, Security Statement or other product-specific notice.
Where Presago processes Personal Data on behalf of a customer, individuals should generally direct requests concerning such data to the relevant customer.
Our Services are intended for business and professional use and are not directed to children.
Notice to End Users
Many of our Services are provided to you through an organization, such as your employer. Where applicable, that organization may manage your access to the Services and information associated with your use of them.
If you use a business email address to access the Services, the organization that owns or controls the associated domain may, where supported by the applicable Product, establish or assert administrative control over your account or access to the Services. In such cases, your organization’s administrator may be able to manage your account, access or related information in accordance with the Product’s functionality and the organization’s policies.
Where Presago processes Personal Data on behalf of an organization, privacy requests relating to such data should generally be directed to the relevant organization or its administrator. Presago will assist its customers as required by the applicable DPA and applicable law.
Information we may collect from you
The Personal Data we collect depends on how you interact with Presago and which Services you use.
A. Information You Provide
We may collect information you provide directly to us, including your name, email address, company, job title, account information, communications, support requests, feedback and any other information you choose to provide. Some Personal Data may be required to create an account, enter into or perform a contract, or comply with legal obligations. If you do not provide required information, we may be unable to provide the relevant Service or complete the applicable transaction
B. Information We Receive from Third Parties
We may receive information from Marketplaces, authorized resellers, Merchants of Record, service providers or third-party services connected to our Products. This may include contact, account, subscription, license, order and transaction information necessary to provide and administer the Services.
Where a third party, such as a Merchant of Record, handles a transaction, payment information may be processed directly by that third party in accordance with its own privacy terms.
C. Information Collected Automatically
When you use our websites or Products, we may automatically collect technical and usage information such as IP address, browser and device information, timestamps, identifiers, diagnostic information, security events and information about how the Services are accessed and used.
We may also use cookies and similar technologies.
D. Customer Data Processed Through the Products
Depending on the Product and functionality used, Personal Data provided by or on behalf of a customer may be transmitted, temporarily processed or stored by Presago as necessary to provide the relevant Product.
The categories of Customer Data and applicable data handling practices may vary by Product and are further described, where applicable, in the relevant Product documentation, Security Statement or other product-specific notice. Where Presago processes such data on behalf of a customer, the applicable DPA also applies.
How We Use Personal Data
We may use Personal Data for the following purposes:
To provide and administer the Services, including managing accounts, subscriptions, licenses and customer relationships, and providing support. We rely on contractual necessity where applicable and otherwise on our legitimate interests in providing the Services to our customers;
To operate, maintain and improve our Services, including monitoring usage, performance and reliability. We rely on our legitimate interests in developing and improving our products and business;
To protect our Services, customers and rights, including preventing fraud, abuse, unauthorized access and security incidents, enforcing our agreements and resolving disputes. We rely on our legitimate interests and, where applicable, legal obligations;
To communicate with you, including responding to requests and sending administrative or service-related communications. We rely on contractual necessity where applicable or our legitimate interests;
For marketing and promotional purposes, including personalized advertising, remarketing and measuring advertising campaign performance, where permitted by applicable law. We rely on consent where required and otherwise on our legitimate interests in promoting our business. You may opt out of marketing communications at any time and manage or withdraw consent to advertising cookies and similar technologies through the Cookie Settings on our website;
To comply with legal obligations and protect legal rights, including responding to lawful requests and establishing, exercising or defending legal claims. We rely on our legal obligations and our legitimate interests in protecting and enforcing our legal rights;
For other purposes with your consent, where consent is required by applicable law.
Where Presago acts as a Controller, it Processes Personal Data only for the purposes described in this Policy. Where Presago Processes Personal Data on behalf of a customer, such Processing is governed by the applicable Data Processing Agreement.
Presago may also use technical and operational data relating to the Services, and aggregated or de-identified data that no longer identifies any individual, to operate, secure, analyse and improve its products and services. Presago does not use Customer Personal Data to train or fine-tune artificial intelligence models.
Where we rely on legitimate interests, we consider whether those interests are overridden by your rights and interests. Where processing is based on consent, you may withdraw your consent at any time without affecting processing already carried out.
Who We Share Personal Data With
We may share Personal Data with the following categories of recipients where necessary:
Service providers that help us operate, host, secure, support, analyze or improve our Services, subject to appropriate confidentiality and data protection obligations.
Marketplaces, resellers and Merchants of Record where necessary to manage purchases, subscriptions, licenses, orders and related customer relationships. These third parties may process Personal Data under their own privacy terms.
Third-party services connected to our Products, where you or your organization choose to connect or use such services. Data may be transmitted to or received from those services as necessary to provide the requested functionality and will also be subject to the third party’s terms and privacy practices.
Your organization and its administrators, where the Services are provided or managed through an organization.
Website analytics and advertising partners that help us understand how visitors use our website, promote Presago’s products and measure campaign performance. These partners may collect or receive browsing information and online identifiers through cookies and similar technologies, including to personalize advertising, with your consent where required by law. Authorities or other parties where required by law or reasonably necessary to comply with legal obligations, enforce our agreements, establish or defend legal claims, or protect Presago, our customers, users or others from fraud, abuse, security threats or harm.
Parties involved in a business transaction, such as a merger, acquisition, financing, reorganization or sale of all or part of our business or assets.
Other parties at your direction or with your consent, where applicable.
Data Security

Data storage and retention
We retain Personal Data only for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, comply with legal obligations, resolve disputes, enforce our agreements and protect our Services and rights.
Retention periods may vary depending on the nature of the data, the purposes for which it is processed and applicable legal, contractual or operational requirements. When Personal Data is no longer required, we will delete or anonymize it or, where immediate deletion is not reasonably possible, securely isolate it until deletion is possible.
Where Presago processes Customer Personal Data on behalf of a customer, applicable retention and deletion practices are governed by the relevant Product, the applicable DPA, customer instructions and, where applicable, Product documentation or Security Statements.
Data Location and International Transfers
Personal Data may be processed in the European Economic Area (“EEA”) and in other countries where Presago or its service providers operate.
Where Personal Data is transferred from the EEA, the United Kingdom, Switzerland or another jurisdiction that restricts international transfers, we use appropriate safeguards as required by applicable law, which may include adequacy decisions, Standard Contractual Clauses or other lawful transfer mechanisms

Your Rights
Depending on applicable law, you may have the right to:

Where Presago processes Personal Data on behalf of a customer, requests relating to such data should generally be directed to the relevant customer. Presago will assist the customer as required by the applicable DPA and law.
You also have the right to lodge a complaint with a competent data protection authority, including in the country where you live or work or where you believe a violation occurred.

We and our service providers and partners may use cookies and similar technologies on our Websites and, where applicable, in our Services for purposes such as authentication, security, functionality and analytics, and on our Websites for advertising and campaign measurement.

Recruitment and Job Applications
When you apply for a position with Presago or otherwise express interest in working with us, Presago acts as a Controller of the Personal Data you provide.
We collect the information contained in your application, including your name, contact details, CV or résumé, employment and education history, and any other information you choose to share with us. We may also collect information generated during the selection process, such as interview notes, assessments and the outcome of the process, and information from publicly available professional profiles or from referees you have identified.
We use this information to assess your suitability for the role, to communicate with you during the selection process, to comply with our legal obligations and, where you agree, to consider you for future opportunities. We rely on steps taken at your request prior to entering into a contract, on our legitimate interests in managing recruitment, on legal obligations where applicable, and on your consent where we retain your information for future opportunities.
Your information may be shared with our service providers supporting recruitment and, where relevant, with the hiring team and management. We do not use automated decision-making to evaluate applications.
If your application is unsuccessful, we retain your information for twelve (12) months following the conclusion of the selection process and delete it afterwards. With your separate consent, we may retain your information for up to twenty-four (24) months in order to contact you about future opportunities. You may withdraw your consent or request deletion at any time, and we will delete your information without undue delay.
The rights described in the "Your Rights" section of this Policy apply to recruitment data.
